Experienced Commercial Litigation Attorney (6-10 years)

Commercial Litigation | Construction Law | Contract Disputes

Compensation: $200,000-$225,000+ commensurate with experience

Position

We are seeking an experienced commercial litigation attorney with six (6) to ten (10) years of substantive commercial litigation and transactional experience to join our law firm. The ideal candidate will have substantial experience handling complex commercial disputes, construction litigation, and contract claims and must be capable of independently managing litigation from commencement through final resolution.

This is a senior-level position for an attorney who can take ownership of matters, exercise sound judgment, communicate effectively with clients, and develop and execute litigation strategy with appropriate autonomy

Qualifications:

\n
• At least six (6) years of substantial commercial litigation experience in New York State Courts ;
\n
• Meaningful experience with construction disputes and contract litigation ;
\n
• Demonstrated ability to independently manage cases through all stages of litigation;
\n
• Strong deposition experience, including both taking and defending depositions;
\n
• Excellent legal research, analytical, and writing skills;
\n
• Strong motion practice and oral advocacy skills;
\n
• Excellent negotiation skills and practical judgment;
\n
• The ability to analyze complicated factual records and contractual relationships;
\n
• Strong organizational skills and the ability to manage multiple active matters and deadlines simultaneously;
\n
• Excellent interpersonal and communication skills; and
\n
• Professional, responsive, and confident approach to client interaction and management.
\n

Responsibilities:

Independently handle all phases of commercial litigation and transactional case management, including:

\n
• Draft, review and negotiate contracts; analyze project records, financial records and other complex materials;
\n
• Assess, develop and execute winning litigation strategy from start to finish;
\n
• Analyze causes of action, draft pleadings: complaints, answers, counterclaims, cross-claims and third-party complaints;
\n
• Strategize and implement an aggressive discovery plan;
\n
• Conducting effective depositions; preparing witnesses for testimony;
\n
• Draft and argue dispositive motions, including summary judgment motions and discovery motions;
\n
• Expertly handle court conferences and hearings and conduct oral argument on motions;
\n
• Analyze damages, exposure and settlement strategy, and negotiate resolutions;
\n
• Experienced at trials, mediation, arbitration and evidentiary hearing experience
\n
• Direct case strategy, deadlines, discovery and compliance with court orders; and
\n
• Advise clients on strategy, developments, risk, costs and potential outcomes throughout the matter.
